1. Acceptance of Terms

By accessing and using WindSpace ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement.

1.1 Electronic Acceptance

You may accept these Terms through various electronic means, including but not limited to:

• Clicking "I Agree" or similar buttons on our website or platform
• Communicating your acceptance via Telegram, email, or other electronic channels
• Using the Service after receiving these Terms
• Making a payment for any WindSpace service

All forms of electronic acceptance are legally binding. By communicating with us via Telegram or other channels and proceeding to use the Service, you confirm that you have read, understood, and agree to these Terms.

2. Service Description

WindSpace provides digital advertising infrastructure and management services, including but not limited to:

• Advertising accounts on major platforms (Facebook, Google, TikTok, and others)
• Business Manager accounts and Facebook Pages
• Browser environment and profile management solutions
• Proxy and IP infrastructure
• Payment processing and transaction reconciliation tools
• Account monitoring and replacement services

2.1 Our Role

WindSpace operates as a digital infrastructure provider. We provide the accounts, tools, and technical environment; you retain full control over your advertising content, targeting, and campaign strategy.

3. Account Eligibility & Verification

To use WindSpace services, you must:

• Be at least 18 years of age or the age of legal majority in your jurisdiction
• Have the legal capacity to enter into binding agreements
• Provide accurate information about your business and intended use
• If representing a business, have authority to bind that entity to these Terms

3.1 Verification Through Available Channels

WindSpace may request reasonable verification of your identity and business through available communication channels (such as Telegram, email, or other platforms). This may include:

• Confirming your Telegram identity and contact information
• Requesting information about your business activities and advertising goals
• Asking for relevant business documentation if operating in restricted categories

You agree to provide accurate information and cooperate with reasonable verification requests. Failure to do so may result in service suspension.

3.2 Account Security

You are responsible for maintaining the security of all account credentials, browser profiles, and infrastructure access provided by WindSpace. Any activity under your account is your responsibility.

4. Payment & Refund Policy

4.1 Payment Terms

Fees are charged based on your selected service plan. WindSpace accepts multiple payment methods including cryptocurrency. You are responsible for any applicable taxes in your jurisdiction.

4.2 Cryptocurrency Payments

WindSpace accepts cryptocurrency payments, including but not limited to USDT and other stablecoins. By making cryptocurrency payments, you acknowledge and agree that:

• All cryptocurrency transactions are final and irreversible once confirmed on the blockchain
• You are solely responsible for ensuring the correct wallet address, network, and amount
• WindSpace is not liable for funds sent to incorrect addresses or on incorrect networks
• You are solely responsible for any tax obligations arising from cryptocurrency transactions in your jurisdiction
• All funds used for payment originate from legitimate sources and comply with applicable anti-money laundering (AML) and counter-terrorism financing (CTF) laws
• WindSpace may request documentation verifying the source of funds for large or unusual transactions

4.3 Account Balance & Top-Ups

When you load funds into an advertising account through WindSpace, those funds are held in the respective platform's account and used for your advertising campaigns.

4.4 Full Refund Policy

• Service Termination: If you choose to stop using our services, we will refund 100% of any unused balance remaining in your advertising accounts.
• Account Issues: If an account experiences technical problems or restrictions not caused by policy violations, unused funds will be fully refunded.
• Platform Changes: If a platform makes policy changes that prevent you from using the account as intended, unused balances will be refunded.

Refunds for cryptocurrency payments will be processed in the same cryptocurrency or equivalent value at the time of refund, at WindSpace's discretion.

4.5 Account Replacement Guarantee

Replacement accounts are provisioned as quickly as possible. Any unused balance from the restricted account will be transferred to the new account or refunded at your request.

4.6 Non-Refundable Items

The following are non-refundable:

• Service fees and subscription charges (monthly/annual plans)
• Advertising spend that has already been used for active campaigns
• Funds spent on campaigns that violated platform policies
• Infrastructure access fees (browser profiles, proxy subscriptions) once provisioned

5. Your Responsibilities

5.1 Compliance with Platform Policies

You agree that all advertising campaigns run through WindSpace accounts will:

• Fully comply with the advertising policies of the respective platforms (Meta, Google, TikTok, etc.)
• Comply with all applicable laws in the jurisdictions you target
• Not infringe on any third-party intellectual property rights

5.2 Proper Use of Infrastructure

All infrastructure provided by WindSpace — including accounts, browser environments, proxies, and management tools — must be used in accordance with these Terms. You acknowledge that:

• You are solely responsible for how you use and configure the infrastructure provided
• Advertising platforms may restrict or terminate accounts at their discretion regardless of compliance
• WindSpace does not guarantee that accounts will remain active indefinitely
• You will not use WindSpace infrastructure to circumvent platform security measures for fraudulent purposes

5.3 Platform Account Ownership

You acknowledge that advertising accounts, Business Managers, and Pages are subject to the respective platform's Terms of Service. Platforms retain ultimate authority over their accounts and may take enforcement actions at any time. WindSpace provides access and management services for these accounts but cannot override platform decisions.

5.4 Restricted Categories

If you advertise in restricted categories such as gambling, financial services, pharmaceuticals, or alcohol, you warrant that you possess all necessary licenses and approvals required by:

• The advertising platform
• The jurisdictions where your ads will be shown
• Any relevant regulatory authorities

WindSpace relies on your representation that you have obtained proper authorization.

5.5 Right to Review and Audit

While WindSpace does not routinely review your advertising content, we reserve the right to review, audit, or request information about your campaigns at any time to ensure compliance with these Terms and applicable laws. This includes the right to:

• Request copies of landing pages, ad creatives, or offers being promoted
• Verify licenses or permits for restricted categories
• Conduct periodic compliance checks
• Request additional business information or documentation

You agree to cooperate promptly with any compliance review. Failure to cooperate may result in service suspension or termination.

5.6 Notification Obligations

You must notify WindSpace immediately (within 24 hours) if:

• You receive any legal notice, subpoena, or regulatory inquiry related to your advertising activities
• You become aware that your campaigns may violate applicable laws
• Your business licenses or permits are revoked, suspended, or under review
• A platform initiates a formal policy review or investigation against your account
• You are contacted by law enforcement regarding your advertising activities

Failure to notify WindSpace may result in immediate termination without refund and forfeiture of indemnification protections.

5.7 Prohibited Activities

• Fraud, phishing, or financial scams
• Malware distribution or hacking
• Content exploiting or endangering minors
• Promotion of terrorism or violence
• Money laundering or terrorist financing
• Sale of illegal drugs or controlled substances
• Human trafficking or exploitation
• Using WindSpace infrastructure for any activity that constitutes a crime under international law

These prohibitions apply globally, regardless of local laws. Violations will be reported to relevant authorities.

6. Service Availability & Support

6.1 Uptime

We strive to maintain high service availability. However, we cannot guarantee uninterrupted access due to factors including platform maintenance, technical issues, or circumstances beyond our control.

6.2 Customer Support

Our support team is available to assist with:

• Account setup and configuration
• Technical troubleshooting
• Balance transfers and refunds
• Account replacement requests
• Infrastructure and tool support

Support response times vary by plan level. Priority support is available for premium plans.

7. Termination

7.1 Termination by You

You may terminate your WindSpace account at any time by contacting support. Upon termination:

• All unused account balances will be refunded within 7-14 business days
• Access to all accounts, infrastructure, and tools will be revoked
• Any outstanding fees must be settled

7.2 Termination by WindSpace

We reserve the right to suspend or terminate your account if:

• You violate these Terms or platform advertising policies
• We receive reports of fraudulent or illegal activity
• Your account poses a risk to our infrastructure or other clients
• Payment obligations are not met
• You fail to comply with notification obligations or audit requests

In cases of termination for policy violations, unused balances may be forfeited. In all other cases, unused balances will be refunded.

8. Limitation of Liability

8.1 Service Provided "As Is"

WindSpace services are provided on an "as is" basis. While we work to ensure quality and reliability, we cannot guarantee that accounts will never be restricted or that platforms will not change their policies.

8.2 Liability Cap

WindSpace's total liability for any claim shall not exceed the total amount you paid to WindSpace in the six (6) months immediately preceding the claim.

8.3 Exclusions

We are not liable for:

• Loss of profits or business opportunities
• Platform policy enforcement decisions (account bans, ad rejections, BM restrictions)
• Changes to third-party platform policies or features
• Indirect, consequential, or punitive damages
• Loss of data, configurations, or browser profiles due to platform actions
• Cryptocurrency price fluctuations or blockchain network issues

Note: This limitation does not affect your right to refunds under Section 4.

9. Indemnification

You agree to indemnify and hold harmless WindSpace, its employees, and partners from any claims, damages, or legal costs arising from:

• Your advertising content or campaigns
• Your violation of platform policies or applicable laws
• Your infringement of third-party rights
• Your use or misuse of WindSpace infrastructure
• Disputes with end-users or regulatory authorities
• Your failure to comply with notification obligations

This means if someone sues us because of your advertising activities or your use of our infrastructure, you are responsible for those legal costs and damages.

10. Anti-Money Laundering & Financial Compliance

WindSpace is committed to preventing the use of our services for money laundering, terrorist financing, or any financial crime.

10.1 Source of Funds

You represent and warrant that all funds used through WindSpace services — whether fiat currency or cryptocurrency — originate from legitimate sources. WindSpace may request documentation verifying the source of funds for large transactions or in cases of unusual activity.

10.2 Suspicious Activity Monitoring

WindSpace monitors transactions for unusual patterns. If suspicious activity is detected, we may:

• Request additional documentation or explanation
• Temporarily suspend your account pending review
• Report suspicious activities to relevant authorities as required by law
• Decline or reverse transactions that we reasonably believe are associated with illegal activity

10.3 Compliance with Financial Regulations

You agree not to use WindSpace services to circumvent any financial regulations, sanctions, or embargoes. You warrant that you are not listed on any government sanctions list and that you will not conduct transactions involving sanctioned individuals, entities, or countries.

10.4 Cryptocurrency Compliance

For cryptocurrency payments specifically, you additionally warrant that:

• The cryptocurrency wallet(s) you use are not associated with any illegal activity
• You comply with all cryptocurrency regulations applicable in your jurisdiction
• You understand and accept the regulatory risks associated with cryptocurrency transactions

11. Data & Privacy

11.1 Data We Collect

We collect account information, transaction records, and usage data necessary to provide our services. We do not access or store the content of your advertising campaigns.

11.2 Data Security

We use industry-standard security measures including encryption, access controls, and regular security audits to protect your data.

11.3 Data Retention

We retain your data for as long as your account is active and for a reasonable period thereafter as required for legal compliance and dispute resolution.

12. Cooperation with Authorities

WindSpace will cooperate with law enforcement and regulatory authorities when legally required. This may include disclosing account information in response to valid legal process.

Where legally permissible, we will notify you before disclosing your information.

13. Dispute Resolution

13.1 Informal Resolution

If you have a concern, please contact our support team first. Most issues can be resolved through direct communication.

13.2 Arbitration

If we cannot resolve a dispute informally, it will be settled through binding arbitration rather than court litigation. The arbitration will be conducted in English, and the decision will be final and binding.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email, Telegram, or through your account dashboard.

Continued use of the service after changes take effect constitutes acceptance of the updated Terms. If you disagree with changes, you may terminate your account and receive a full refund of unused balances.

15. General Provisions

15.1 Governing Law

These Terms are governed by the laws of the Socialist Republic of Vietnam.

15.2 Severability

If any provision is found invalid, the remaining provisions remain in full effect.

15.3 Entire Agreement

These Terms constitute the entire agreement between you and WindSpace regarding our services.

15.4 Assignment

You may not transfer your account without our consent. We may assign these Terms without restriction.

15.5 Force Majeure

Neither party shall be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to: natural disasters, government actions, internet disruptions, platform outages or policy changes, blockchain network congestion, or regulatory changes affecting cryptocurrency transactions.
